Regulations of the BLACK FRIDAY PROMOTION by Raw Nest sp. zoo sp. k

§1 General provisions

These Regulations define the rules for using the services provided by Raw Nest spółka z ograniczoną odpowiedzialnością spółka komandytowa with its registered office (hereinafter referred to as "Raw Nest") at ul. Ślusarska 6/ LU4, 30-710 Kraków, entered into the register of entrepreneurs of the National Court Register by the District Court for the city of Kraków in Kraków, 11th Commercial Division of the National Court Register under the number 0000750164, with a share capital of PLN, with NIP: 6772437941, REGON : 381371474.

§2 Definitions

Services - Preparation and delivery of drinks by Raw Nest - cold-pressed juices from vegetables and fruits, flavored waters and other drinks obtained using the cold press method (hereinafter referred to as Beverages).

Customer - A natural person or business entity using the Services.

Online store - an online service available on the website www.rawnest.pl enabling the purchase of Raw Nest products electronically,

Premises - Raw Nest headquarters located at ul. Ślusarska 6/ LU4, 30-710 Kraków.

§3 Subject of the order

1. The subject of the order (hereinafter referred to as the Order) are Services in the flavor variants selected by the Customer and in the quantity indicated by the Customer, subject to the minimum order quantity of 6 drinks and the possibility of choosing their flavors from those available by Raw Nest in the Online Store www.rawnest.pl in the following configuration : :

2. Beverages are delivered in tightly closed packages, which are then packed into collective cardboard packages. Collective packaging is delivered by a company with appropriate authorizations to transport food at a specific temperature.

3. Prices of individual Drinks and food, in specific flavor variants, valid on the day of placing a given Order are presented in the Online Store.

§4 Placing an Order

1. The Services are ordered by submitting an appropriate instruction by the Customer in one of the following ways:

- for individual customers: Order via the Online Store www.rawnest.pl;

2. The order is considered placed when confirmation of its receipt is sent to the Customer via e-mail, containing: Customer data, Order number, selected type and quantity of Services, delivery address and delivery date, and other information relevant to a given Order.

3. Raw Nest is not responsible for the composition of Beverages and food in relation to food allergies and other diseases and ailments of the Customer requiring the elimination or limitation of consumption of specific products, of which the Customer did not inform Raw Nest when placing the Order.

4. Acceptance and execution of the Order - also taking into account the information referred to above, does not constitute acceptance of responsibility by Raw Nest for any unfavorable well-being of the Customer or a negative reaction of the body to the set of ingredients, in particular due to lack of knowledge about the other fluids and fluids consumed by the Customer. meals.

5. The order must be placed at least 48 hours before the planned start of detox, excluding Saturdays, Sundays and statutory holidays.

6. You can change the planned delivery date once at least 7 days before the planned shipment.

7. Promotional prices are valid only until Friday, November 27, 2020, until 23/59/59

§5 Payment for the Order

1. The Customer is obliged to pay for the Order before its implementation in accordance with the following guidelines:

• for individual customers, Raw Nest allows payments only via the electronic payment system provided by Raw Nest in the Online Store, and Raw Nest considers the day of receipt of payment to be the day on which it received confirmation of the entire payment from the system operator,

2. Raw Nest only processes paid Orders. Deliveries to the customer are made on Tuesdays, Wednesdays, Thursdays and Fridays.

3. Payments are handled by PayLane sp. z o. o. based in Gdańsk at ul. Norwida 4, postal code: 80-280, KRS: 0000227278.

§6 Delivery

1 Delivery of the Order takes place on the date indicated by the Customer; in the case of deliveries within Krakow, it is possible to establish a delivery time range. Deliveries made outside the city of Krakow are made in cooperation with external courier companies. Raw Nest is not responsible for delays resulting from the fault of courier companies.

2. If the Customer fails to collect the Order on the delivery date indicated by the Customer due to any circumstances not reported before 9:00 a.m. on the day preceding delivery, the Order is deemed to have been effectively delivered. In such a case, the Customer is not entitled to submit any claims for failure to receive the Order due to the short shelf life of the Beverages.

§7 Changes and cancellation of the Order

1. The Customer is entitled to change the Order in parts regarding:

- delivery date, provided that the execution of the Order has not started;

- delivery address, provided that the notification took place before the Order was sent.

2. Changes are considered made when the Customer receives confirmation of the change.

3. Cancellation of the Order by the Customer is possible at any time, provided that the execution of the given order has not started. The customer is obliged to inform Raw Nest about cancellations or changes via e-mail at the appropriate address: biuro@rawnest.pl.

4. The Customer is not entitled to a refund for the Order due to its partial or total cancellation after the commencement of the Order.

§8 Complaints

1. If there is any discrepancy in the execution of the Order compared to the Order placed or these regulations, the Customer is entitled to submit a complaint (hereinafter referred to as the "Complaint").

2. The complaint should be submitted electronically and sent to: biuro@rawnest.pl.

3. A complaint is considered submitted when the Customer receives confirmation of acceptance of the Complaint, no later than within 2 business days following receipt of the Complaint.

4. Raw Nest allows for a maximum of 14 business days to consider the complaint from sending confirmation of receipt of the Complaint.

5. If the Complaint is accepted, Raw Nest will inform the Customer electronically about the possibilities of resolving the matter.

6. If the Complaint is not accepted, Raw Nest will inform the Customer about the lack of justification for its positive consideration, providing appropriate justification.

§9 Withdrawal from the contract and return of goods

1. Pursuant to Article 38 section 4 of the Act on Consumer Rights dated 30/05/2014 The Customer is not entitled to withdraw from a distance contract and return the goods without giving a reason in the case of using the Services provided by Raw Nest, because the subject of the Services provided is an item that deteriorates quickly and has a short shelf life.

2. When placing an Order and paying for it, the Customer is aware of the inability to withdraw from a distance contract and return the goods without giving a reason.

§10 Privacy Policy

  1. The administrator of personal data is Raw Nest spółka z ograniczoną odpowiedzialnością spółka komandytowa with its registered office (hereinafter "Raw Nest") at ul. Ślusarska 6/ LU4, 30-710 Kraków, entered into the register of entrepreneurs of the National Court Register by the District Court for the city of Kraków in Kraków, 11th Commercial Division of the National Court Register under the number 0000750164, with a share capital of PLN, with NIP: 6772437941, REGON : 381371474.
  2. Providing your personal data is voluntary, with the reservation that it will be impossible to complete the order without the Customer's data.
  3. When registering in our online store, we process personal data for the following purposes:

- enabling the provision of the service electronically and full use of the online store,

- creating and managing your account or accounts, and ensuring the servicing of your account,

  • handling orders you send to us - including contacting you, including for purposes related to the provision of services. Additionally, the law requires us to process your data for tax and accounting purposes.
  1. We also process personal data for the purposes indicated below, based on the legitimate interest of Raw Nest, which is:

- monitoring your activity and that of all other users,

- contacting you, including for purposes related to permitted marketing activities, via available communication channels, in particular and with your consent - by e-mail and telephone;

- ensuring payment services;

- handling your requests, in particular to the user service department and via the contact form when they are not directly related to the performance of the contract;

- pursuing and defending claims.

- conducting statistical analyses;

- storing data for archiving purposes and ensuring accountability (demonstrating our compliance with our obligations under the law).

5. The legal basis for the processing of personal data is the Regulations for the provision of services and execution of orders by Raw Nest sp. zoo sp. k of May 7, 2019, which is necessary to accept in the event of registration in our online store

6. The legal basis for the processing of personal data necessary to issue a VAT invoice in connection with the order is the tax obligation imposed on Raw Nest.

7. Personal data will be stored for the entire period during which your account in the online store will exist or for the period of limitation of tax liabilities or civil law claims, depending on which of these periods occurs later.

8. Raw Nest may share your personal data with the following categories of entities:

- law firms providing legal services to Raw Nest,

- entities providing accounting, auditing and debt collection services to Raw Nest,

- entities providing IT and programming support services to Raw Nest,

- postal operators and the so-called courier companies to the extent necessary to process orders

9. At any time, the customer has the opportunity to rectify, delete or limit the processing of his or her personal data. Every data subject has the right to object to processing and the right to transfer data. Access to data is possible:

10. Each data subject has the right to lodge a complaint with the supervisory authority, which is the Inspector General for Personal Data Protection, ul. Stawki 2, 00-193 Warszawa (from May 25, 2018, the name of the supervisory body may change).

 

§11 Information about COOKIES files

1. Raw Nest does not automatically collect any information, except for information contained in cookies.

3. The entity that places cookies on the end device of the Online Store customer and obtains access to them is Raw Nest

4. Cookies are used for the following purposes:

▪ adapting the content of Raw Nest websites to customer preferences and optimizing the use of websites; in particular, these files allow you to recognize the device of the Online Store customer and properly display the website, tailored to his individual needs;

▪ creating statistics that help understand how customers of the Online Store use websites, which allows improving their structure and content;

▪ maintaining the Online Store customer's session (after logging in), thanks to which the customer does not have to re-enter the login and password on each subpage of the Online Store;

5. The Online Store uses two basic types of cookies: "session cookies" and "persistent cookies". "Session" cookies are temporary files that are stored on the customer's end device until logging out, leaving the website or turning off the software (web browser). "Permanent" cookies are stored on the customer's end device for the time specified in the cookie parameters or until they are deleted by the customer.

6. The Online Store uses the following types of cookies:

▪ "necessary" cookies enabling the use of services available in the Online Store, e.g. authentication cookies used for services requiring authentication in the Online Store;

▪ cookies used to ensure security, e.g. used to detect abuses in the field of authentication within the Online Store;

▪ "performance" cookies, enabling the collection of information on how to use the Online Store's websites;

▪ "functional" cookies, enabling "remembering" the settings selected by the customer and personalizing the customer interface, e.g. in terms of the selected language or region from which the customer comes, font size, website appearance, etc.;

▪ "advertising" cookies, enabling the provision of advertising content to customers more tailored to their interests.

7. In many cases, the software used to browse websites (web browser) allows cookies to be stored on the client's end device by default. Customers of the Online Store may change cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to inform each time they are placed on the device of the Online Store customer. Detailed information about the possibilities and methods of handling cookies is available in the software (web browser) settings.

8. The Online Store Operator informs that restrictions on the use of cookies may affect some functionalities available on the Online Store's websites.

9. Cookies placed on the end device of the Online Store customer may also be used by advertisers and partners cooperating with the Online Store operator.
